E-mutation

Namjari (e-mutation)

 Everyone is more or less familiar with Namjari (e-mutation). Some get property by inheritance, others by purchase. In that case, everyone has to register the land. Many people may not know how to do Namjari. Because of this, many people get registered with the help of brokers/ land grabbers/ munshis or any other middlemen. It costs you extra money. And if you know how to do it, you can get it registered without any hassle.

Firstly, if you have any problem to understand the Namjari process, there is a 'Helpdesk' or 'Seba Kendra' open at the AC Land Sadar Circle Office. A dedicated office assistant is available round the clock to assist you. He will help you with any problem.

Nomjari/rejection of deposit/mutation, whatever the case may be, should be applied for in accordance with Land Administration Board Memorandum No. 20-AS-17/84 (140) dated 18-7-1984 sent to the Additional Deputy Commissioner (Revenue) .

When is registration required?

01) Due to the death of the land owner, the names of the heirs are to be recorded in the government records;

As per Section 321 of Land Management Manual 1990 in case of heirs, the Assistant Commissioner (Lands) will verify the necessary documents and order the registration. In this case, without opening any new holding, the names of the heirs are included in the holding in place of the previous holding by deducting the name of the deceased, distributing the shares/land according to Faraiz.

2) If the land is transferred by way of sale, donation, heba, waqf, acquisition, auction order, settlement, etc., it must be recorded in the name of the new land owner;

03) If ownership is obtained by civil or civil court judgment or decree, application for registration can be made according to that judgment.

Necessary documents in Namzari application

First of all, you need to have the following documents for a full enrollment application:

01) Original Application Form (This is mandatory).

02) One copy of passport size photograph (applicable for each in case of multiple persons) (Mandatory).

03) Latest Khatian (Khatian of the person from whom the land was purchased or inherited) (This is mandatory) [A format of Khatian is shown].

04) Court fee of Rs.20 (mandatory).

05) Original inheritance certificate (Succession Certificate issued by public representative like Magistrate/Class I Officer/Chairman of Union Parishad/Member of Parliament) issued within three months in case of inheritance. [Bandatory for heirs only].

According to section 143 (b) of the State Acquisition and Tenancy Act, on the death of a record owner, his heirs shall register a deed of distribution among themselves. Apply for nomination along with the registered allotment.

06) National Identity Card/Passport/Nationality Certificate (Issued by Ward Councillor) (Mandatory).

07) Certified/photocopy of document if owner by purchase (mandatory if owner by purchase).

08) Photocopies of Baya/Pit Deeds (if the said land has been bought and sold more than once, copies of all the documents will be required from the one in whose name it was last registered, i.e. mandatory).

9) Land Development Tax (LD Tax) or Rent Receipt (mandatory) for the current year.

10) Certified/photocopy of the said judgment (compulsory) if land ownership is obtained through court judgment decree.
